This is one of the most frequently misunderstood requirements in UK cosmetics law. Many independent brands either don't know it applies to them, use an incorrect address, or confuse the UK requirement with the EU one. Any of these can lead to enforcement action from the Office for Product Safety and Standards (OPSS).
Here's exactly what the Responsible Person requirement means, who can fulfil it, and what you need to do.
What is the Responsible Person?
The Responsible Person (RP) is the legal entity, a company or an individual who takes accountability for a cosmetic product's compliance with UK law. They are the point of contact for UK authorities if a safety issue arises, and they bear legal responsibility if the product is found to be non-compliant.
This isn't a title or a badge. It's a genuine legal obligation. The OPSS can contact the Responsible Person at any time regarding a product to request safety documentation, investigate a complaint, or issue corrective action.
In 2019, a UK company was fined over £4,000 for failing to include the Responsible Person's name and address on a cosmetic product label. In 2020, another was fined £17,000 for multiple labelling failures. The requirement is enforced.
What does the Responsible Person actually have to do?
Under the UK Cosmetics Regulation, the Responsible Person must:
- Ensure the product complies with UK Cosmetics Regulation before it's placed on the market
- Maintain a Product Information File (PIF) for each product, available in English, for ten years after last placement on market
- Notify the OPSS via the Submit Cosmetic Product Notification (SCPN) portal before the product is sold
- Report any Serious Undesirable Effects (SUEs) to the OPSS immediately, these include hospitalisations, disabilities, or deaths linked to product use
- Ensure labelling, claims, and advertising are accurate and not misleading
- Know which ingredients are used, including any restricted or prohibited substances
- Take corrective action including product recall if a product is found to be non-compliant
